The genocide trial against former dictator Efrain Rios Montt is due to reopen in Guatemala on Thursday, July 23. The trial gripped the nation when Rios Montt was convicted of genocide in 2013. However, the attention on the anticipated retrial has been limited given the obstacles to prosecution, as well as the country’s growing political crisis, following massive corruption scandals brought to light by the International Commission Against Impunity in Guatemala (CICIG) and the public prosecutor.

Earlier this year ninety-five witnesses, most of them Ixil Mayas, testified against a former Guatemalan dictator. Efraín Ríos Mont was on trial for genocide. This is the first time an ex-chief of state has been tried for this heinous crime in his own country. A panel of three judges found him guilty and sentenced him to eighty years in prison. The conviction was quickly overturned on a technicality; Ríos Montt is 86 years old and, even if a new trial confirms the verdict, the closest he will get to prison is a military hospital.

The trial of Efrain Rios Montt for genocide has been pushed back to January 2015; a court official said that judges were too busy with other cases to resume the trial during 2014. Families of victims of the armed conflict expressed regret at the decision to push the resumption of the trial back this far. Hector Reyes, a lawyer with the Center for Human Rights Legal Action (CALDH), criticized the new date and said that the court decision is a violation of victims' rights.

El 19 de mayo se anuló la sentencia sobre genocidio, proferida por un tribunal del país. La razón de Estado aducida consistió en que el país no está preparado para tal declaración, pues se había producido una polarización de impredecibles consecuencias. Ese anunciado futuro no encuentra asidero en eventos causantes de una futura disolución social. Es decir, que extranjeros o nacionales expusieran abiertamente "ideas, programas o normas de acción" para perturbar el orden público o promover un cambio al margen de la Constitución Política.

El Acuerdo o Carta de Londres del 8 de agosto de 1945, que estableció el Estatuto del Tribunal de Núremberg, definió como "crímenes contra la humanidad" el "asesinato, exterminio, esclavitud, deportación y cualquier otro acto inhumano contra la población civil, o persecución por motivos religiosos, raciales o políticos, cuando dichos actos o persecuciones se hacen en conexión con cualquier crimen contra la paz o en cualquier crimen de guerra". La Convención sobre imprescriptibilidad de los crímenes de guerra y de los crímenes de lesa humanidad considera el genocidio del género crímenes de lesa humanidad.

On May 10, 2013, after 30 years of state-sanctioned impunity, the victims of army violence in Guatemala’s 36-year civil war saw a glimpse of relief when former de facto president General Jose Efraín Ríos Montt was convicted on charges of genocide and crimes against humanity. Judge Jazmín Barrios, who presided over the case, revoked Ríos Montt’s house arrest and ordered him immediately to prison to serve out his 80-year sentence.
